The script isn’t written yet so there is no telling. No villain is cast yet.

The Riddler as Eddie Murphy or Johnny Depp was just a rumor (I hope that it is, that sounds terrible!)
There was another rumor a while back before Dark Knight came out that they were going to do the penguin played by Philip Seymour Hoffman. That idea sounds awesome and I would love to see that.
They could always bring two-face back because I don’t think he died at the end of Dark Knight.
Harley Quinn would be cool to see, she could be working for The Joker, continuing his work of mayhem. Although I don’t know if they would use her because she wasn’t an original comic book villain, she was made for Batman: The animated series.
There are a lot of villains to choose from, I can’t wait for the next installment of Christopher Nolan’s series.

I think they should bring back Aaron Eckhart as Harvey Dent/Two-Face. I think it would be cool to see Two-Face being more crazy, like talking to himself, like he does in the comics. I also wouldn’t mind seeing The Riddler, but not tame, sort of like Jigsaw, have like a riddle maze that he throws people in and if they can’t solve the riddles they die.
