Since Nolan says he probablly wont make make another Batman film, can’t Smallville use the character. Or is there more to it than that? Does he have to sign off his rights to Batman or something?

At the end of Batman Begins, we were teased with the Joker and saw him in Dark Knight. Did we get teased with any potential villains for the 3rd film? Or have there been any details about the plot or characters released?
Any info or even speculation is appreciated.
